Terms of Service

Greetings and welcome to Mergo!

These Terms of Service ("Agreement") are entered into between the Mergo Team ("Company," "Android App," or "Service Provider") and users of the Mergo Android Application (the "App") and its associated services ("you" or "Member"). This Agreement governs your use of the Mergo Android App for communicating with other Members and accessing all related online services ("Services"). By clicking the "Register" button on the registration form within the Mergo Android App, you acknowledge, accept, and agree to be bound by all terms and conditions outlined herein, and consent to completing your registration with Mergo.

If you do not agree to any provision of this Agreement, do not click the "Register" button. Clicking this button binds you to these terms, regardless of whether you finalize the registration process or purchase any Services. Mergo reserves the right to modify this Agreement at any time. Revised terms will take effect immediately upon being posted within the App (via in-app notification) or on our official website, and such posting shall constitute sufficient notice to you. Your continued use of the Services after modifications confirms your acceptance of the updated Agreement.

1. Membership Eligibility Requirements

By registering for a Mergo account via the Android App, you certify and warrant (and acknowledge that Mergo relies on these certifications to comply with Google Play Developer Program Policies and applicable laws) the following:You are at least 18 years of age.

• You are at least 18 years of age, in full compliance with Google Play’s Minor Protection Policies and the Children’s Online Privacy Protection Act (COPPA). Mergo implements mandatory age verification measures, including integration with Google Account age checks and birth date validation during registration, to prevent minors from accessing the App.

• You are not prohibited from using the Services under the laws of the United States, your country of residence, or any other applicable jurisdiction—including being banned from Google Play’s platform or violating Google Play’s Developer Program Policies.

• You will adhere to this Agreement, all relevant local/state/national/international laws/rules/regulations, and Google Play’s Content Policies, Developer Program Policies, and Data Safety Requirements.

• You have never been convicted of a felony, indictable offense, sex crime, or any crime involving violence, and you are not required to register as a sex offender (consistent with Google Play’s policies on user safety).

Membership is null and void in jurisdictions where it is prohibited. Using the Mergo Android App signifies that you possess the legal right, authority, and capacity to enter into and comply with this Agreement. All registration information must be accurate, complete, and truthful. Providing false, inaccurate, or incomplete information may result in immediate account suspension or termination until proper verification is completed (per Google Play’s Account Integrity Policies). You may not authorize third parties to use your membership, share your account credentials, or transfer your account to another person. You are solely responsible for maintaining the confidentiality of your password and all activities conducted under your account. Any transactions or actions performed using valid login credentials for the Android App shall be deemed legitimate and binding on you.

2. Membership Terms and Termination

2.1 Account Creation

You may create a Mergo account either through manual registration within the Android App or by using your Google Account ("Third-Party Account"). Using a Google Account constitutes your explicit authorization for Mergo to access, display, and utilize limited information from that account (e.g., name, email, profile photo) as detailed in our Privacy Policy—all in compliance with Google Play’s Data Safety Requirements and Google’s API Terms of Service.

2.2 Termination

• By You: You may terminate your membership at any time by submitting a written request to dreamshoprevolution@gmail.com or using the in-app "Delete Account" feature (located in Settings > Account & Security), which initiates data deletion in compliance with Google Play’s Data Deletion Requirements.

• By Mergo: Mergo may terminate or suspend your membership immediately (with notice sent to your registered email) for any reason, including but not limited to: (i) violation of this Agreement or Google Play’s policies; (ii) fraudulent or illegal activity; (iii) receiving credible reports of harm to other users; or (iv) inactivity for 180+ consecutive days.

2.3 Refund Policy (Compliant with Google Play Refund Policies)

• If Mergo terminates your membership without just cause, you will receive a pro-rated refund of any unused paid services. Refunds will be processed through Google Play’s official refund system within 7–14 business days.

• No refunds will be issued if your membership is terminated due to a breach of this Agreement, Google Play’s policies, or at your own request (except as required by mandatory law or Google Play’s 48-Hour Refund Window for accidental purchases).

• Paid services (including subscriptions) are non-refundable unless explicitly stated otherwise, or if required by Google Play’s Mandatory Refund Rules (e.g., defective services, unauthorized charges).

This Agreement shall remain in effect after membership termination, including (but not limited to) provisions related to intellectual property, indemnification, limitation of liability, and data retention.

2. Subscription Terms (Compliant with Google Play Subscription Policies)

If you purchase a subscription to access premium Services:

• Recurring Billing: Payment will be charged to your Google Play account upon confirmation of purchase. Subscriptions automatically renew for the same duration and at the same price unless canceled at least 24 hours before the end of the current billing period.

• Renewal Charges: Your Google Play account will be charged for renewal within 24 hours prior to the end of the current period. You will receive a reminder notification via Google Play and the App at least 72 hours before renewal.

• Cancellation: You may manage or cancel your subscription at any time through Google Play’s account settings: Open Google Play > Tap your profile icon > "Payments & subscriptions" > "Subscriptions" > Select Mergo > "Cancel subscription". No partial refunds will be provided for canceled subscriptions, but you will retain access to premium features until the end of the current billing period.

• Trial Periods: If a free trial is offered, you will not be charged during the trial period. Unless canceled at least 24 hours before the trial ends, your subscription will automatically convert to a paid plan, and your Google Play account will be charged the applicable fee.

4. Permitted Usage and License

The Mergo Android App is intended exclusively for personal, non-commercial use, in strict compliance with Google Play’s policies on non-commercial app usage. Organizations, companies, businesses, or entities of any kind are prohibited from registering as Members or using the Services.

The following activities are strictly forbidden (and may result in account termination, legal action, and reporting to Google Play):

• Illegal or unauthorized use of the Services (e.g., scraping member data, sending unsolicited spam, creating unauthorized links to the App).

• Developing or distributing competitive products (e.g., databases, apps, software) that replicate or compete with Mergo’s core functionality.

• Engaging in commercial activities (e.g., advertising, soliciting sales, money transmission) via the App without Mergo’s prior written consent.

• Using false identities, impersonating others, or operating multiple accounts for commercial or fraudulent purposes.

5. Intellectual Property Rights

Subject to your full compliance with this Agreement and Google Play’s Developer Program Policies, Mergo grants you a personal, limited, non-commercial, non-exclusive, non-sublicensable, non-transferable, and revocable license to access and use the App and Services on a single Android device for personal use only. If you access the Services through Google Play or another third-party Android platform, you are also bound by that platform’s terms of service.

This license does not authorize you to:

• Copy, modify, reverse engineer, decompile, disassemble, extract source code from, or tamper with the App (in violation of Google Play’s Anti-Tampering Policies).

• Distribute, sell, lease, rent, or sublicense the App or Services to any third party.

• Use the App in a way that exceeds reasonable usage limits, or that interferes with the App’s functionality or other users’ experience.

Mergo reserves the right to revoke this license immediately if you violate any terms of this Agreement or Google Play’s policies.

6. Intellectual Property Rights (Compliant with Google Play Intellectual Property Policies)

Mergo owns or retains all intellectual property rights in and to the App, Services, and all associated content (e.g., logos, text, graphics, code, features). This includes copyrights, trademarks, patents, trade secrets, and other proprietary rights protected by international laws and Google Play’s Intellectual Property Policies.

• Copy, modify, publish, transmit, distribute, perform, display, or sell any of Mergo’s proprietary information without prior written consent.

• Use Mergo’s trademarks, logos, or brand elements (e.g., "Mergo") in any way that implies endorsement or affiliation without explicit permission.

• Infringe on third-party intellectual property rights (e.g., posting copyrighted content without authorization) — violations will be addressed in accordance with the Digital Millennium Copyright Act (DMCA) and Google Play’s Copyright Policies.

7. Member-Posted Content (Compliant with Google Play Content Policies)

You are solely responsible for all content, information, photos, videos, calls, or personal data ("Content") you post, transmit, or share through the App. By posting Content, you grant Mergo an irrevocable, perpetual, non-exclusive, fully paid, worldwide license to use, reproduce, display, distribute, and create derivative works of such Content (solely for the purpose of providing and improving the Services), in compliance with applicable privacy laws and Google Play’s policies.

7.1 Prohibited Content

Content must not violate Google Play’s Prohibited Content List or the following:

• Racism, bigotry, hatred, or promotion of violence, harassment, or bullying.

• Pornography, nudity, bestiality, or sexually explicit content (consistent with Google Play’s Adult Content Policies).

• Defamatory, false, misleading, or fraudulent content (e.g., fake profiles, scam solicitations).

• Illegal content (e.g., drug trafficking, weapons sales, instructions for criminal acts).

• Infringing content (e.g., copyrighted music, movies, or images without permission).

• Exploitation of minors or solicitation of minor’s personal information (zero-tolerance per COPPA and Google Play’s Minor Protection Policies).

• Soliciting passwords, financial information, or personal data for commercial or illegal purposes.

• Spam, chain letters, or unsolicited mass communications (compliant with Google Play’s Anti-Spam Policies).

7.2 Content Moderation

Mergo implements a combination of AI-driven and human content moderation to enforce these rules, consistent with Google Play’s Content Moderation Requirements. Mergo reserves the right to review, remove, or restrict access to any Content at its sole discretion if it violates this Agreement or Google Play’s policies. Repeat violations may result in account termination.

8. Copyright Infringement Policy

The App may integrate or link to third-party services (e.g., Google Maps, Firebase Analytics, payment processors) that are subject to their own terms of service and privacy policies (including Google’s Terms of Service for APIs).

• Your use of third-party services is voluntary, and you assume all risks associated with such use.

• Mergo does not endorse, guarantee, or take responsibility for the security, accuracy, or reliability of third-party services.

• Disputes between you and a third-party provider are your sole responsibility to resolve, in compliance with Google Play’s Third-Party Service Liability Policies.

9. Member Interactions
Mergo complies with the Digital Millennium Copyright Act (DMCA) and Google Play’s Copyright Policies. If you believe your copyrighted work has been infringed upon through the App, please submit a DMCA takedown notice to Mergo’s Copyright Agent (dreamshoprevolution@gmail.com) containing the following:

1. A physical or electronic signature of the copyright owner or authorized representative.

2. A detailed description of the copyrighted work allegedly infringed.

3. The specific location of the infringing material (e.g., App screen URL, content ID, member profile link).

4. Your contact information (name, address, phone number, email).

5. A statement that you have a good faith belief that the use of the material is not authorized by the copyright owner, its agent, or the law.

6. A statement (under penalty of perjury) that the information in the notice is accurate and you are authorized to act on behalf of the copyright owner.

Mergo will respond to valid DMCA notices within 48 hours, including removing or disabling access to infringing content, and notifying the alleged infringer. Repeat infringers will have their accounts terminated.

10. Privacy Policy
You are solely responsible for all interactions with other Members (e.g., messaging, meetings, transactions). Mergo does not screen, verify, or endorse other Members, and is not liable for any harm, loss, or disputes arising from Member-to-Member interactions.

To comply with Google Play’s User Safety Policies:

• You agree to exercise caution when sharing personal information (e.g., address, financial details) with other Members.

• You must report any violations of this Agreement, harmful behavior, or suspected minor users via the App’s in-app reporting tool or by emailing dreamshoprevolution@gmail.com.

• Mergo may investigate reports and take action (e.g., account suspension, content removal) to protect user safety, but has no obligation to mediate disputes.

11. Suppliers
Using the Services requires the collection and processing of personal data. Mergo’s Privacy Policy (compliant with Google Play’s Data Safety Requirements, GDPR, CCPA, and COPPA) outlines:

• The types of data collected (e.g., account info, device data, optional location data).

• How data is used, stored, and protected (e.g., TLS 1.3 encryption, AES-256 storage encryption).

• Data sharing with third parties (e.g., Google Firebase for analytics, payment processors).

• Your rights to access, correct, delete, or export your data (via in-app tools or written request).

By using the App, you explicitly agree to the terms of the Privacy Policy. The Privacy Policy is incorporated into this Agreement by reference.

12. Member Account Suspension/Termination

Mergo may engage independent third-party suppliers or affiliates to assist in providing the Services (e.g., translation services, customer support, marketing). Suppliers are independent contractors, and Mergo is not liable for their acts, omissions, or service quality. All supplier services are provided "as is" without warranties of any kind (express or implied), in compliance with Google Play’s Warranty Policies.

13. Indemnification
You agree to indemnify, defend, and hold harmless Mergo, its subsidiaries, affiliates, officers, directors, agents, and employees from and against any and all third-party claims, damages, liabilities, costs, and expenses (including reasonable attorneys’ fees) arising from:

• Your use of the App/Services in violation of this Agreement, Google Play’s policies, or applicable law.

• Your breach of any representations/warranties in this Agreement.

• Your posted Content (e.g., infringement claims, defamation, harassment).

• Unauthorized use of your account by third parties (unless caused by Mergo’s gross negligence).

This indemnification obligation survives the termination of this Agreement and applies regardless of fault, to the maximum extent permitted by law.

14. Disclaimer of Warranties

The App and Services are provided "as is" and "as available" without any warranties, express or implied, including but not limited to:

• Warranties of merchantability, fitness for a particular purpose, or non-infringement.

• Warranties that the App will be uninterrupted, error-free, or secure (Mergo disclaims liability for service outages due to internet connectivity, device issues, or third-party failures).

• Warranties regarding the accuracy, reliability, or authenticity of Member Content or interactions.

Mergo does not warrant that the App will comply with all local laws or regulations outside the United States—you are responsible for ensuring compliance with your country’s applicable rules.

15. Limitation of Liability
To the maximum extent permitted by applicable law and Google Play’s policies:

• Mergo shall not be liable for any indirect, consequential, exemplary, incidental, special, or punitive damages (e.g., lost profits, data loss, emotional distress) arising from your use of the App/Services.

• Mergo ’s total liability to you for any claim (whether in contract, tort, or otherwise) shall not exceed the amount of fees you paid to Mergo in the 12 months preceding the claim.

• Mergo shall not be liable for any damages caused by third-party services, Member actions, or events beyond its reasonable control (e.g., natural disasters, cyberattacks).

16. No Use by Minors
Mergo strictly complies with COPPA and Google Play’s Minor Protection Policies. Individuals under 18 years of age are prohibited from using the App or Services.

• Age verification measures include Google Account age checks, birth date validation, and manual review of suspicious accounts.

• If Mergo becomes aware that a minor has registered an account, the account will be immediately terminated, and all personal data will be deleted within 72 hours (in compliance with COPPA’s data deletion requirements).

• Any conduct endangering minors (e.g., entrapment, exploitation, abuse, encouraging self-harm) will result in permanent account termination, legal action, and reporting to law enforcement and Google Play.

If you encounter a minor using the App, please report it immediately via the in-app reporting tool or dreamshoprevolution@gmail.com.

1. 17. Indemnification (General)
   Headings: Clause titles are for reference only and do not affect the interpretation of this Agreement.

2. Severability: If any provision is deemed invalid, illegal, or unenforceable, the remaining provisions shall remain in full force and effect.

3. Language: The English version of this Agreement shall prevail in case of discrepancies between language versions (required for Google Play’s global distribution).

4. Waiver: Failure by Mergo to enforce any provision shall not constitute a waiver of that or any other provision.

5. Entire Agreement: This Agreement constitutes the entire understanding between you and Mergo regarding the App/Services, superseding all prior or contemporaneous agreements (oral or written). Additional terms may apply to third-party content/services (e.g., Google Play’s Terms of Service).
